Tide and Atlas Travel LLC – Terms & Conditions

1. General Terms

By booking travel services with Tide and Atlas Travel LLC, an independent travel agency affiliated with Outside Agents / Cruises & Tours Unlimited (“CTU”), you (“the Client,” “you,” or “your”) agree to the following Terms and Conditions. Please read carefully before confirming any travel arrangements or making payments.

Tide and Atlas Travel LLC (“the Agency,” “we,” or “us”) acts solely as an independent contractor and agent for Outside Agents / Cruises & Tours Unlimited and as an intermediary between you and travel suppliers (such as airlines, hotels, cruise lines, tour operators, and insurance providers).

All travel services are subject to the terms, conditions, and policies of the individual Suppliers, which may limit liability and govern refunds, changes, and cancellations.

2. Our Role and Responsibility

Tide and Atlas Travel LLC and Outside Agents / Cruises & Tours Unlimited do not own, operate, or control any travel Suppliers. Your travel arrangements are subject to each Supplier’s own contract, and all payments are made in accordance with those Supplier terms.

We are not responsible for any Supplier’s acts, omissions, negligence, or failure to perform, nor for any personal injury, property damage, delay, inconvenience, or other loss caused by such parties or by events outside our control.

3. Payments and Credit Card Authorization

By providing your credit card information, you authorize Tide and Atlas Travel LLC, Outside Agents / Cruises & Tours Unlimited, and/or the Supplier(s) to charge your card for all travel-related costs, including deposits, final payments, service fees, and applicable taxes.

You agree not to initiate a credit card chargeback or payment dispute for any transaction you have authorized. In the event of a dispute, you must contact Tide and Atlas Travel LLC directly to resolve the matter.

If a chargeback or dispute is initiated and reversed in our favor, you will be responsible for any associated costs, including administrative, collection, or legal fees.

4. Cancellations, Refunds, and Changes

All cancellation or modification requests must be made in writing to Tide and Atlas Travel LLC.

Refunds, if applicable, are subject to the Supplier’s terms and conditions. Many travel products, including airfare, tours, and cruises, are non-refundable or subject to cancellation penalties.

Tide and Atlas Travel LLC’s professional service fees and planning fees are non-refundable under all circumstances, regardless of Supplier policies or force majeure events.

We strongly recommend purchasing comprehensive travel insurance to protect your investment against cancellation, medical emergencies, or other disruptions.

5. Travel Documents and Requirements

You are solely responsible for ensuring that all travelers have valid passports, visas, and other required travel documents prior to departure.
Tide and Atlas Travel LLC is not liable for any losses resulting from incomplete or incorrect documentation or denial of entry by any authority.

6. Travel Insurance

Travel insurance is strongly recommended. If you decline travel insurance, you accept full responsibility for any losses related to trip cancellation, delay, medical emergencies, or other travel disruptions.

7. Liability Disclaimer

Tide and Atlas Travel LLC and Outside Agents / Cruises & Tours Unlimited are not responsible for:

Acts, errors, or omissions of any Supplier or third party
Mechanical failures, weather, acts of God, pandemics, or government actions
Schedule changes, strikes, or any events beyond our control

Our total liability, if any, shall not exceed the amount paid to the Agency for the specific travel services in dispute.

8. Client Responsibilities

You agree to:

Review all itineraries, invoices, and travel documents upon receipt and report any discrepancies within 48 hours
Abide by all Supplier policies and terms
Provide accurate traveler information, including names as they appear on government-issued identification

Failure to comply may result in additional costs or travel issues for which you accept full responsibility.

9. Service Fees

Tide and Atlas Travel LLC may charge non-refundable professional service fees for research, booking, customization, or cancellations. These fees are separate from Supplier charges and are retained regardless of trip outcome.

10. Force Majeure

We are not responsible for failure to perform or deliver services due to causes beyond our reasonable control, including natural disasters, pandemics, government restrictions, or supplier insolvency.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any legal action shall be brought exclusively in the courts of Chesterfield County, Virginia.

12. Acknowledgment and Acceptance

Payment of a deposit or completion of a booking constitutes acknowledgment that you have read, understood, and agreed to these Terms and Conditions on behalf of yourself and all members of your traveling party.
